Terms and Conditions
These terms and conditions (“Terms”), along with the Privacy Policy (available at [simplisell.my/privacy] (https://simplisell.my/privacy)) (“Privacy Policy”), collectively referred to as the “User Agreement,” constitute an electronic record in terms of the Malaysian Electronic Commerce Act 2006, the Personal Data Protection Act 2010, and other relevant Malaysian legislation.
This User Agreement is published in accordance with the requirements of the Malaysian Communications and Multimedia Commission (MCMC) and the Digital Signature Act 1997, governing the operations of the SimpliSell.my website (“Website”) and its associated mobile application (“Platform”), operated by MirrAR Innovation Technology Private Limited. MirrAR is in partnership with Go Digital Production for marketing purposes.
‘User’ refers to any natural or legal person who agrees to these Terms by using the Platform. Users may be required to provide their legal consent if acting on behalf of a company or entity.
MirrAR Innovation Technology Private Limited, partnered with Go Digital Production for marketing, operates the Platform. MirrAR is registered in India, with marketing activities supported by Go Digital Production, located at T2-10-07, Tower 2, Third Avenue, Jalan Teknokrat 3, Cyber 4, 63000 Cyberjaya, Selangor, Malaysia, contactable via Ms. Buvna at (014-625 1750).
Use of the Platform constitutes acceptance of these Terms. Non-agreement prohibits the use and access to the Platform.
The Company may modify these Terms or the Privacy Policy at any time without prior notice. Continued use of the Platform after such modifications constitutes acceptance of such changes.
Specific terms such as “Affiliate,” “Authority,” “Grievance Officer,” “Services,” etc., are defined according to their standard legal definitions under Malaysian law, ensuring clarity and compliance.
Users must be at least 18 years old or of legal age to form a binding contract under Malaysian law. Minors may use the Platform only under the supervision of a guardian.
Users are responsible for maintaining the confidentiality of their account and password and for all activities under their account.
Users agree to provide true, accurate, current, and complete information about themselves as prompted by the Platform’s registration form.
Users agree to use the Platform only for lawful purposes and not to engage in any activity that is illegal or infringes on the rights of others.
The Platform facilitates transactions between buyers and sellers, where terms of payment are regulated by Malaysian law. Details on payment methods, refunds, and cancellations are governed by the Consumer Protection Act 1999 and related regulations.
The Platform and all its content, including software, designs, text, images, and other material, are protected by intellectual property laws. Users may not use any content without permission from the rightful owner.
Go Digital Production, as a marketing partner of MirrAR, assists in promotional activities for SimpliSell.my in Malaysia. All marketing practices adhere to Malaysian advertising and marketing laws.
This Agreement is governed by and construed in accordance with the laws of Malaysia. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of Malaysia.
